Terms of Service

This is a private beta. Cole is early-stage software offered by invitation to a small number of operators. It is provided “as is,” may change or break, and these Terms may be updated as the product evolves.

These Terms of Service ("Terms") govern your access to and use of the Energy application, also branded Cole by SanctifAI (the "Service"), provided by SanctifAI ("SanctifAI," "we," "us"). The Service is currently offered as a private beta. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

The Service is an invite-only beta offered to businesses. You must be at least 18 years old and authorized to act on behalf of the organization you represent. Accounts are provisioned by SanctifAI or an organization’s account owner. You are responsible for keeping your credentials secure and for all activity under your account.

Beta service

The Service is provided as a beta. It may change, be interrupted, or contain errors, and features may be added or removed at any time. We do not guarantee any particular level of availability, performance, or uptime during the beta.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Access data or accounts that do not belong to your organization.
  • Attempt to disrupt, probe, or compromise the security of the Service.
  • Reverse engineer or copy the Service except as permitted by law.

Your data

As between you and SanctifAI, your organization owns the business data it submits to the Service ("Customer Data"). You grant us the rights necessary to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the rights to submit Customer Data and that doing so complies with applicable law.

Intellectual property

The Service, including its software, design, and content provided by SanctifAI, is owned by SanctifAI and protected by intellectual property laws. These Terms do not grant you any rights in the Service except the limited right to use it as described here.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, SanctifAI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Service.

Termination

We may suspend or terminate access to the Service at any time, including if you violate these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The exclusive venue for any dispute will be the state or federal courts located in Delaware, and you consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
